Uma avaliação crítica da antropologia jurídica de Bronislaw Malinowski

Resumo

Este artigo analisa a produção intelectual de Bronislaw Malinowski sobre o direito entre os povos "primitivos", concentrando-se principalmente na recepção de seu trabalho no campo da antropologia jurídica. Revisamos a análise malinowskiana do direito, destacando seu lugar dentro da teoria funcionalista, as inovações teóricas e metodológicas que apresenta com relação aos precedentes no campo e alguns conceitos específicos que foram posteriormente objeto de debate. Em seguida, reunimos as objeções mais frequentes à antropologia jurídica de Malinowski na literatura específica, examinando quatro tipos de críticas: primeiro, as que atacam a extensão dada ao conceito de lei; segundo, as que visam questionar a relevância da distinção entre lei civil e lei penal; terceiro, as que apontam para a hipertrofia racional que Malinowski acreditava ter encontrado nos nativos; e, finalmente, as múltiplas objeções à coerência e à continuidade das definições de Malinowski ao longo de seus escritos.
