Balance crítico de la antropología legal de Bronislaw Malinowski

El artículo recorre la producción intelectual de Bronislaw Malinowski sobre la ley en los pueblos “primitivos”, atendiendo principalmente a la recepción de su trabajo en el campo de la antropología legal. Revisamos el análisis malinowskiano del derecho, destacando el lugar que éste ocupa dentro de la teoría funcionalista, las innovaciones teóricas y metodológicas que presenta respecto a los antecedentes en la materia, y algunos conceptos particulares que fueron posteriormente objeto de debate. Reunimos luego las objeciones más frecuentes a la antropología legal de Malinowski dentro de la literatura específica, examinando cuatro tipos de críticas: primero, aquellas que atacan la extensión dada al concepto de ley; segundo, las que se dirigen a cuestionar la pertinencia de la distinción entre derecho civil y criminal; tercero, las que señalan la hipertrofia racional que Malinowski creía encontrar en los nativos; y por último, las múltiples objeciones a la coherencia y continuidad de las definiciones de Malinowski a lo largo de sus escritos.
