Abstract

Punitive damages essentially have a punitive or sanctioning purpose, and from understanding this main function, the necessary requirements that justify their imposition in cases of damage to consumers must be specified. Along with the task of defining the origin of punitive damages, there is the task of establishing reasonable criteria that allow justifying their quantification. Said
criteria have been expanded in the Draft Consumer Defense Law (art. 118) with respect to the statements in the current regime (art. 52 bis Consumer Defense Law) which is highly positive to serve as guidelines for a better justification of the amount that is judicially ordered to pay as a dissuasive punitive fee.
