Rights in the agenda of judicial court: gender identity in prison

Abstract

Jurisprudential analysis required, increasingly, an effort to think in an interdisciplinary way social issues involving the law. In this regard, the proposal of this paper is to critically analyze a judicial decision at the end of 2012 in Córdoba, Argentina. This judicial sentence conceded the request for transfer of a trans woman, that was in the men’s prison, to the women’s prison. From this legal and social fact, I propose analyze some dimensions about the impact of gender identity law of Argentina in the context of prison confinement.
