Socio-historical analysis perspective on legal effectiveness: the case of Colombia and Argentina.

Through their constitutional reforms, Colombia (1991) and Argentina (1994) incorporated a series of social, economic, and cultural rights, which in both states formed a new constitutionality plexus. This incorporation as a reflection of the particular modernizing processes modified the meaning of the legal systems forged under the idea of universality, and consequently, legal effectiveness in all its aspects. This paper, as part of a broader investigation, proposes to delineate a perspective of socio-historical analysis that allows to address in the future the resulting legal effectiveness around women's rights.
