Abstract

This paper analyzes the international responsibility of States for lack of due diligence, something that was not resolved within the framework of the International Law Commission of the United Nations (ILC) draft on responsibility of States for internationally wrongful acts (2001). We highlight the differences between the different projects and make a critical analysis of them in order to clarify the basis on which is now possible to support the international responsibility of States for lack of due diligence.
