Abstract

Notarial responsibility must be analysed understanding its function as a “process”, which includes stages in which documentary and exercise techniques
are developed, which allow achieving a result, that is, the authorization of a valid,
truthful, opposable instrument and that makes faith for yourself. Although this
process can be dismembered for study, and for the correct performance at each stage, it should not be when the purpose is to establish the responsibility of the notary public for the damage produced. In the notary there is a trust imposed by the work he performs. The duty not to harm makes him objectively responsible to the requesting party as well as to third parties.
