Abstract

The present work deals with analyzing article 1891 of the Civil and Commercial Code, referring to positive easements and possession, which, due to its apparent terminological imprecision, is likely to generate confusion when applying certain legal institutions that derive from the possession or that are related to it, for example, the system of possessory and real actions, the possibility of acquisition of real rights through the acquisitive prescription, its classification as
a relationship of power, among other aspects
