Abstract

The judgement that is analyzed deals with an action of environmental protection, interposed by the representatives of a manufacturing plant, by means of which it is sought to put an end to the overturning and spillage of solid urban waste, that indiscriminately realize undetermined persons in the income of the property where the factory is located. The particularity of the case lies in the treatment of environmental interjurisdictionality and the duty of two spheres of government to meet their obligations in the field of each of their powers. The difficulty of environmental management is related to the fact that the people who cause the environmental damage are indeterminate and anonymous. The conflict includes a social issue remediable through environmental education, in order to achieve a cultural change.
