Abstract

In the path of procedural reforms, the Province of Córdoba -Argentine Republic- designed a new procedure with the objectives of reducing the duration of the cases, immediacy of the Judge, favoring conciliation and improving the quality of the resolutions in order to make substantial rights effective. Thus, it adopts oral proceedings as a system for all declarative contentious trials that begin on or after 08/07/2023 and for all those in which, as of that date, the opening of evidence has not been arranged. For this purpose, a procedure was designed based on two hearings with established functions in which the Judge is assigned the role of manager of the cases and even determines the ex officio impulse in a section of the procedure, maintaining the dispositive system, but the new paradigm calls into question the validity of certain institutes designed for the previous written model.
