UNIVERSAL JURISDICTION. ARGENTINA AND SPAIN AS AN EXAMPLE OF SOLIDARITY BETWEEN VICTIMS OF CRIMES AGAINST HUMANITY IN THE FACE OF THE INACTION OF THEIR NATIONAL JURISDICTIONS

In this article we propose to approach the principle of “universal jurisdiction” from the ways in which Spain and Argentina have received it, first in the legal aspects and then in its practical implementation. In this case, precisely from cases in which crimes against humanity occurred in Argentina (trial in Spain) and in Spain (trial in Argentina) were studied. Analyzing a Spanish jurisdictional and legal requirement, we conclude with a political and sociological reflection that considers the limiting assumptions of the “universality” of jurisdiction that arise from a so-called “connection point,” which could be useful to limit reasonably that competence in Argentina.
