Abstract

The essay investigates to what extent the requirements of objectivity in the justification of judicial decisions are satisfied by the theory of compensatory pleasures enshrined in article 1741 of the Civil and Commercial Code for the quantification of non-pecuniary losses. Since we believe they are insufficient, an alternative solution is proposed.
