Abstract

Within the framework of current family law, it is examined on the basis of a comparative analysis of national jurisprudence, foreign law and jurisprudence, whether regulating in our country “surrogacy” provides greater  security, equality and legal protection to people who resort to these techniques or the recognition of this fundamental right “to try to be parents by virtue of one of the assisted human reproduction  techniques” is still left to judicial discretion, to conclude, assuming the need to regulate it for the purposes to provide protection and a fair composition of interests of all those involved.
