Abstract

The sentence that is analyzed deals with the declaration of inapplicability of the right to review the sentence of clarification
of disability. The issue is approached from the models of disability in relation to the international and national normative system for the protection of the rights of people with disabilities. In the judicial sentence the review is framed as a right-duty and -of divided vote- the tension between two models of disability and their consequences is evidenced, covering the influence that these conceptions have on the construction and normative interpretation.
