Abstract

The purpose of this work is to present a reflection on the legal nature of union immunity in Colombia. To this end, the general
aspects of the trade union immunity are contextualized from a theoretical perspective in light of the Labor Code, and the trade union immunity process in the light of the Procedural Code of Labor and Social Security, which are presented as the first and second part, respectively. We went to the documentary or content analysis, where we reviewed the legislation that exists in Colombia in this regard; similarly, founded theory was used, understood as a way of doing analysis. Finally, it is concluded that it is necessary to propose strategies that lead to solve the problems currently faced by the judicial sector in Colombia in matters of trade union immunity, in order to promote harmonious labor relations that lead to the good social and economic development of the parts.
