Abstract

Almost sixty years after the signing of the Antarctic Treaty (AT), the Antarctic system faces three new major challenges: the environment, which is projected on other two: tourism, and bioprospecting. Bioprospecting poses great challenges to the legal system, both in terms of the space in which it is possible to exercise it and in relation to the conditions of its development, given the resurgence of the effects of territorial claims that could be caused by linking this activity with sovereignty over the natural resources of the respective claimant states.
