DEMOCRACIA DELIBERATIVA Y PROVINCIAS: UNA DISCUSIÓN NECESARIA EN EL MARCO DEL FEDERALISMO ARGENTINO

Article 1, in accordance with article 22 of the National Constitution, establishes the political system of a democratic and representative nature. In turn, articles 5 and 123 of the same ordinance determine the constitutional guideline that each of the provinces, in order to be able to give themselves their own political and legal organization, must also comply with this. However, this “legal-constitutional clothing” of the 19th century is affected by the lack of legitimacy faced by representatives and the exercise of said power. Given this, deliberative democracy emerges as a necessary alternative, and raises both objections and solutions, which must necessarily adapt to the constitutional mandate of representativeness. Within it, one of the mechanisms proposed, and which has been used in some Argentine municipalities, to promote the participation of the population, and consequently obtain greater legitimacy in government decisions, were participatory budgets.
