EL RÉGIMEN DE RESPONSABILIDAD PENAL DE LAS PERSONAS JURIDICAS POR DELITOS CONTRA LA ADMINISTRACIÓN PÚBLICA Y POR COHECHO TRANSNACIONAL EN EL DEBATE PARLAMENTARIO DE 2017

Resumen

Síntesis: La responsabilidad penal de las personas jurídicas en sí mismas y las sanciones aplicables a éstas, han llegado para quedarse en la legislación de los países de la órbita del Derecho continental europeo, entre los cuales nos contamos. El criterio de imputación de responsabilidad penal de las personas colectivas se basa en un “modelo vicarial” de imputación porque implica que la persona jurídica responde automáticamente cuando un representante suyo ha cometido un delito, en provecho de la empresa, actuando dentro del marco de sus funciones.

Abstract: The criminal liability of legal persons themselves and the sanctions applicable to them, have come to stay in the legislation of the countries of the European Continental Law, among which we have. The criterion of imputation of criminal liability of collective persons is based on a "vicarial model" of imputation because it implies that the legal entity automatically responds when a representative of it has committed an offense, for the benefit of the company, acting within the framework of its functions.
