EL ARBITRAJE DE CONSUMO: COMPLICACIONES EN UN NUEVO CAMINO

Resumen

Síntesis: El arbitraje se ha introducido en el ordenamiento jurídico peruano de tal manera que se ha involucrado en todos las áreas posibles hasta llegar a implicarse en la materia protección al consumidor, en donde se ha creado una Sistema de Arbitraje al Consumidor que aún no se implementa, su reglamento ya ha sido emitido, pero aún le falta un desarrollo mucho más especializado, es necesario hacer cambios que se tienen que adecuarse a la realidad peruana, entre ellos se encuentra el tema procedimental enmarcado en un debido proceso y ello se suma la importancia del laudo arbitral, el cual se emitirá el finalizar el proceso o procedimiento.

Abstract: The arbitration has been introduced in the Peruvian legal system in such a way that it has been involved in all possible areas until becoming involved in the matter of consumer protection, where a Consumer Arbitration System has been created that has not yet been implemented. its regulation has already been issued, but still lacks a much more specialized development, it is necessary to make changes that have to be adapted to the Peruvian reality, among them is the procedural issue framed in a due process and this adds the importance of arbitral award, which will be issued upon completion of the process or procedure.
