Resumen

El presente artículo brinda en forma sintética los detalles del estudio de legislación comparada que se llevó a cabo para aspirar a la Licenciatura en Archivología en el año 2013. Se trató de una investigación multidisciplinar, empleando métodos del derecho y la historia, junto a la teoría archivística y sociológica. El objetivo principal del trabajo fue conocer si la implementación de un Sistema Nacional de Archivos podría ayudar a mejorar la situación de las instituciones archivísticas nacionales, a partir del análisis de la normativa vigente en otros países latinoamericanos que efectivamente poseen Sistemas Nacionales de Archivos: Costa Rica, Ecuador y Perú.

Se trató del primer TFL (trabajo final para la Licenciatura) que abordó el tema de los Sistemas de Archivos desde la perspectiva del derecho comparado. El análisis detallado que se hizo de los Sistemas de Archivos de los países analizados –estudiando su normativa vigente y complementando estos datos con entrevistas a las autoridades de los respectivos Sistemas permitió no sólo corroborar y refutar las hipótesis propuestas, sino también ampliar los horizontes de los conocimientos archivísticos que trabajamos en la Escuela y en el ámbito argentino.

Abstract

This article provides details synthetically about the study of comparative legislation that was held to aspire to a degree in Archival in 2013. Was it a multidisciplinary research, using methods of law and history, along with archival and sociological theory. The main objective of the study was to determine whether the implementation of a National Archives System could help to improve the situation of national archival institutions, from the analysis of current legislation in other Latin American countries that have effectively National Archives Systems: Costa Rica, Ecuador and Peru.

It was the first TFL (final work for Bachelor) which addressed the issue of file systems from the perspective of comparative law. The detailed analysis made of the file systems of the countries analyzed - studying its current regulations and complementing this data with interviews with the authorities of the respective systems - allowed not only corroborate and refute the hypotheses proposed, but also broaden the horizons of archival knowledge which work in the school and in the Argentine field.
